“Ana Camacho, Unipessoal Lda.” (hereinafter referred to as the “Company”), through this document, rents to the Customer the described vehicle under the terms and conditions of this contract, whereby the Customer acknowledges and agrees.
- The Customer has received the vehicle in perfect working condition.
- The vehicle shall only be driven by the Customer and shall not be used:
A) For transporting goods in violation of customs regulations or anything that is illegal in any way;
B) For transporting goods or passengers for any form of remuneration or compensation, implicit or explicit;
C) To push or tow any vehicle or trailer;
D) For sports events;
E) By anyone under the influence of alcohol or narcotics.
- The minimum age of the driver is 21 years old. A valid driving license in Portugal with at least 1 year of experience is required.
- The vehicle is delivered with a warning triangle and a sealed odometer, standard tools, a spare wheel, five marked tires, registration book, title of ownership, green insurance card, and inspection report.
A) The loss or destruction, total or partial, of the vehicle's documentation obligates the Customer to indemnify the Lessor for €150 for associated damages, including expenses related to issuing second copies of the documentation and administrative costs incurred by the Lessor.
- The prices do not include:
Car washing, fines, and in case of an accident, towing the vehicle to the original rental station: The tariffs do not include collision indemnity expenses. Fuel is always at the Customer's expense, who must also regularly check the oil, water, and gearbox oil levels. Any oil expenses must be properly documented for reimbursement, subject to prior analysis by the Company. Normal mechanical maintenance resulting from normal use is covered by the Company. If the vehicle becomes immobilized, repairs can only be made with the prior agreement of the Company and in accordance with the instructions given.
- The prices include limited third-party liability insurance in accordance with the laws of the country, a copy of which can be reviewed at the Company's office.
The Customer may opt for additional insurances: CDW (insurance with a deductible), SCDW (insurance with deductible waiver), and TP (theft protection). If the Customer opts for any of these insurances, the terms, conditions, and 3 exceptions will become an integral part of the contract. All insurance details and information will be provided to the Customer by the Company. Even if the Customer accepts CDW and/or SCDW coverage, any damages caused to the rental vehicle due to misuse will be at the Customer's expense. These insurances do not cover damages to the top and bottom of the vehicle, as long as there is no collision. In case of an accident due to speeding, driving under the influence of alcohol or narcotics, or negligence, the CDW or SCDW insurances become void, and the Customer will pay the full repair or towing costs to the original station, as well as compensation corresponding to the downtime of the damaged vehicle.
- The rental ends on the date set by the Customer. If the Customer wishes to extend the rental period, they must go to the nearest Company station to update their rental contract 24 hours before it expires. If there is no consent, the vehicle is considered to be in use without authorization and against the owner's will, which is punishable by law and the responsibility of the driver.
The Customer must return the vehicle to the rental station unless explicitly authorized otherwise and within business hours.
- The rental cost, as well as any additional services, must be paid at the start of the rental and will be based on the applicable price tables. A refundable deposit, corresponding to the insurance deductible, must also be provided to cover potential damages. The deposit amount will depend on the vehicle's group and the current price tables.
- The Customer also agrees to protect the interests of the Lessor and the rental insurance company in case of an accident during the rental period as follows:
A) Obtain the name and address of those involved and witnesses;
B) Not declare responsibility or guilt;
C) Not leave the vehicle without taking the necessary measures to protect and safeguard it;
D) Immediately notify the police.
10. In case of an accident, loss, damage, or theft, the incident must be immediately reported to the competent police authorities and to Ana Camacho Unipessoal, Lda within 24 hours. The Customer must complete the amicable accident declaration with as much detail as possible, or they may lose their CDW, TP, or SCDW coverage options. The Customer must cooperate with Ana Camacho Unipessoal, Lda and its insurers in any subsequent investigation or legal proceedings.
11. Any modifications or changes to the terms and conditions of this document will be null unless agreed upon in writing.
12. The Company is not responsible for accidents that are not reported to the police, except in cases of force majeure or valid reasons on the part of the Customer. CDW and SCDW do not cover damages to tires, windows, and locks, as well as accidents caused by speeding or under the influence of alcohol or drugs.
13. In case of breach of this contract by the Customer, their personal data may be disclosed or communicated to third parties as necessary for the recovery of damages resulting from the breach.
14. The Company is not responsible for any loss or material damage caused to personal items carried or left in the vehicle, either during or after the rental period.
15. If the vehicle previously contracted or reserved is unavailable, the Lessor ensures the provision of an equivalent service or provides a higher-class vehicle at no additional cost to the Customer.
16. Pre-contractual information provided as part of the reservation regarding general and specific conditions is considered part of the contract content. Any clauses in the contract that are contrary to this will be deemed void. In the event of a reservation breach, the amount paid at the time of reservation will be refunded within 30 days, unless the breach results from a reason not attributable to the Lessor, without prejudice to the application of general civil liability rules.
17. A 24-hour assistance service is provided free of charge for reporting any anomalies that may occur during the contract's execution.
18. The activation of the deposit for damages to the vehicle, whether caused by the Customer or not, will only occur after prior notification and proof of the damages.
19. In case of dispute, the competent court will be the Judicial Court of the Madeira District, with express waiver of any other, unless there are serious inconveniences for one of the parties, which are not justified by the interests of the other party.
